Olshan Client Alfa Consult SA Achieves Victory at Trial

Olshan client Alfa Consult SA (“Alfa”) achieved complete victory at trial on its claims for breach of contract and breach of the implied covenant of good faith and fair dealing in the federal civil case entitled Alfa Consult SA v. TCI International, Inc. Alfa is a Luxembourg-based telecommunications company and TCI International (“TCI”), a wholly owned subsidiary of SPX Corporation, is an American supplier of spectrum monitoring and management products. In 2021, Alfa filed suit against TCI in the Northern District of California alleging that TCI breached an exclusive agency agreement for the construction of spectrum monitoring systems in Iraq. After three years of litigation in a foreign jurisdiction, Alfa had its day in court. On January 17, a jury returned a unanimous verdict in favor of Alfa and awarded it $5 million in damages.
